The buyer must make a non-interest-bearing down payment of CHF 50,000.00 at the auction, immediately after the third call and before the award:

a) by presenting an irrevocable payment promise from a bank subject to the Federal Law on Banks and Savings Banks, in favor of the Debt Enforcement Office in Dietikon, which may only be subject to the condition of the award and must be unconditional in all other respects, or

b) CHF 50,000.00 in cash

The down payment can also be deposited in advance at the Debt Enforcement Office by transfer (IBAN CH10 0900 0000 8001 6606 1, Debt Enforcement Office Dietikon, Neumattstrasse 24, 8953 Dietikon) or in cash. The credit to the account must be made at the latest two working days before the auction. If the credit or deposit in cash is made later, the down payment is considered not made and must be made at the auction itself as described above (if necessary, again). Such a pre-payment will not be interest-bearing and will be refunded to the payer within 14 working days after the real estate auction, if the property was not awarded to him.

Persons who bid as representatives in someone else's name, as a member of a legal community or as an organ of a legal entity must identify themselves as representatives immediately before the award. Representatives of associations and foundations must also identify their power of representation. Commercial companies and cooperatives must also present an extract from the commercial register immediately before the award.

We hereby call upon the mortgage creditors (and the other parties involved) to register their claims on the property, in particular also for interest (in the case of a debt instrument, only the interest actually owed according to Art. 818 para. 1 no. 3 ZGB) and costs, by September 3, 2026, at the Debt Enforcement Office in Dietikon, and to state at the same time whether the capital claim is already due or has been terminated, if applicable for what amount and on what date.

Within the same period, all easements that were established under the previous cantonal law before 1912 and have not yet been registered in the public books must also be registered. If they are not registered, they can no longer be asserted against a bona fide acquirer of the property, unless they are also legally effective without registration in the land register according to the provisions of the Civil Code.
